Lease from the Bedford County, Va Deed Book, Deed I9

This Indenture made the twelfth day of February in the year of our Lord one thousand seven hundred and ninety five, between James Calloway of the County of Bedford of the same past and of Justinian Wills and Elizabeth Wills his wife of the same county of the other past witnesseth that the said James Calloway doth hereby lease and confirm to them the said Justinian Wills & Elizabeth Wills his wife during their natural lives part of the tract of land which the said James Calloway purchased of Jo(unreadable) Thomas (last name unreadable) in Bedford County an being the place where their son William Wills lately lived with liberty to clear as much adjoining land as will support them and their family of children free from tax they the said Justinian Wills & Elizabeth Wills his wife paying to him the said James Calloway the yearly rent of one ear of Indian Corn and being careful not commit waste of timber on said land. To have and to hold said land during their natural lives free from the claim on demand from him the said James Calloway his heirs or (unreadable) and from claim and demand of all other persons whatsoever. But it is understood that if the said James Calloway should think proper to sell the aforesaid land at anytime before the decease of said Justinian Wills and Elizabeth his wife he has full liberty to do so provided he provides place as equally as good and convenient for the said Justinian Wills and Elizabeth his wife to reside on during said term of their lives. In witness whereof each party hath here unto set their hands & seals the day and year first above written………..

In the court held for Bedford County the 27th day of April 1795. This lease was acknowledged by James Calloway party thereto and proved as to Justinian Wills by the oath of Wm. Farley & John B. Wills witnesses whose names are theresaid to subscribe & ordered to be recorded.
