Last Will and Testament of James Wills, Senior ("Nelson County. Virginia, Will Book B." pages 178-77-78) Dated 29 Sept. 1820. Probated 26 Feb., 1821 "In the name of God, Amen:' Firstly, I, James Wills of Nelson County, Virginia, being weakened and on low state of health, but of sound disposing mind and memory, do make this my last will and testament in manner and form following, that is to say, in the first place I desire all of my just debts shall be speedily paid by my executors out of the first monies they may receive after my death. 2nd. 1 give, devise and bequeath to my grandson. Jefferson L. Wills, son of my son, James Wills Jr. dec'd,, two-hundred and filly acres of the tract of land on which his mother now resides, the entire tract containing four-hundred acres, three hundred and sixty-seven of which was purchased under deed of trust made by my said son James to Murphy, Brown & Co., and thirty-three acres residue was purchased by me of my said son by deed of record in the Court of Nelson County which said two-hundred and fly acres having been intended to he given to my said grandson, I wish land of such manner by my said executors as to include the dwelling house to him and to his heirs forever, reserving the liberty to his Mother to use the said land and enjoy, the benefits thereof jointly with him during her natural life or widowhood. The residue of the tract being one hundred and fifty acres. I devise and bequeath to my granddaughter Pamela Smith, the wife of James Smith, to her and to the heirs of her body forever. I also give my said granddaughter the negroes (2) namely, Gordon and Hannah now in the possession of her mother, Elizabeth Wills, to her and the heirs of her body forever. The residue of my negroes on said plantation, consisting of John. Creasy, Hill and Disy (and) now in the possession of my said daughter-in-law, Elizabeth Wills (wife of James Wills, Jr. Dec'd.), 1 give and devise and bequeath to my grandson, Jefferson L. Wills and to his heirs forever, allowing to his mother the liberty as to use and profit in the same manner as the land left them during her life or widowhood. Having advanced considerable sum of money for my said son, James in his lifetime it is not my will and desire that his children should have any more of my estate nor do I wish them to be held responsible for any such advancement made to their said father. 3rd. I give, devise and bequeath to my daughter, Rebeeca Martin, wife of James Martin, three hundred acres of land lying in Blizes (Blezes) Hollow and adjoining the land belonging to the estate of Lucas Powell,. dec'd and others to be run offby a line directed by my executors as to include the quantity to her portion equal to the land here-to-fore given to the rest of my children. 4th. 1 give, devise and bequeath to my granddaughter, Nancy Williamson, one-hundred and eighty-four acres on the head waters of Ruchers Run to be held and enjoyed by her and heirs until her son, Montraville shall arrive to the age oftwenty-one years at which time I give and bequeath the said one hundred acres of land to him the said Montreville and to his heirs forever. The said one hundred and eighty acres being the tract laid off end surveyed by George Higginbotham 12th day of April 1819. 1 give this land in consideration to my daughter Pony Hill's tract being of less value than the land given the rest of my children. 5th.To my sons, John, Lawrence and Catlett (I) have heretofore executed deeds for the land I intended to give them which I now confirm together with such slaves as I have given them, and now in their possession to them and their heirs forever. 6th. I give, and bequeath to my son, Catlett, whom I hereby constitute a trustee for the purpose, three-hundred and twelve acres of my tract of land lying in Amherst Co,, called Treat's Ferry tract to be run off as my executors shall direct to be held by him, my said son Catlett, for the use of and benefit of my dau. Nancy Phillips and her children during the life of my said dau., and at her death I give the said three-hundred and twelve acres of land to be equally divided among her children or legal representatives. 7th. To my daughters, Judith Thompson and Lucy Higginbotham, I give and confirm the lands 1 have heretofore executed deeds for to their husbands, John Thompson and Joseph C. Higginbotham, together with the slaves I have given them and now in their possession, to them and their respective heirs and assigns forever. 8th. I hereby confirm the gift of all slaves made to any of my children and now in their possession, to their heirs forever. 9th. All the rest and residue of my property of any description not herein before disposed of together with all monies which be on hand at the time of My death and all monies then due me, I leave to be equally divided among all of my children (except the children of my son, James Wills, Jr., dec'd.). share and share alike, each accounting for what money I have advanced them in my life-time. The parts falling to my daughters, Polly (Mary) Hid and Nancy Phillips, to be received by . Joseph C. It is not my wish that my son, Willis should account for any monies which I have heretofore advanced to him in the general division of my estate, as I intended the monies so advanced him to go in hen of lands, having never made him a title to any.
